General Provisions:<\/h4>\n<div class=\"wpb_text_column wpb_content_element \" style=\"text-align: justify;\">\n<div class=\"wpb_wrapper\">\n<p>1) These Regulations define the rules for the proper use of the rented vehicle (hereinafter: the \"Vehicle\"), and the rights and obligations of the Lessee and the Lessor.<br \/>2) If the Vehicle has been made available by the Lessee to another person, it is the Lessee's duty to truthfully inform that person about the content of these Regulations. The Lessee is responsible for any actions of the person to whom they provided the Vehicle that are inconsistent with the rental rules.<br \/>3) The Vehicle may only be driven by a person holding a valid driving license as understood by Polish law.<br \/>4) The Lessee is not entitled to sublet, lend, or transfer the Vehicle to third parties without the prior written consent of the Lessor. This reservation does not apply to immediate family members of the Lessee (i.e., ascendants, descendants, siblings, and the Lessee's spouse).<br \/>5) The Lessor, or other persons authorized by the Lessor, has the right to inspect the manner of use and condition of the Vehicle, as well as the Lessee's documents related to the aforementioned circumstances, and the Lessee is obliged to enable such inspection and provide the aforementioned documents.<br \/>6) Whenever these Regulations refer to the \"Fee specified in the Table of Fees,\" it shall mean the fee that a Lessee who is not a consumer is obliged to pay to the Lessor regardless of the Lessee's fault, and regardless of the amount of damage incurred by the Lessor and the amount of compensation received by the Lessor in connection with the Vehicle's insurance. The Lessor is entitled to claim supplementary compensation from the Lessee if the administrative fee does not cover the entire damage. In the case of Lessees who are consumers, the fee specified in the Table of Fees serves an informational purpose and represents the approximate amount of damage incurred by the Lessor in the event of a given incident. A Lessee who is a consumer is liable on the principle of fault, subject to broader liability provided for by law. A Lessee who is not a consumer is only released from liability by force majeure and the exclusive fault of the Lessor.<br \/>7) Unless otherwise agreed, the Lessee is obliged to settle all Vehicle rental fees at the Lessor's cash desk or by bank transfer to the Lessor's bank account number: 74102029060000120203974789, maintained by PKO BP in Krakow.<br \/>8) In the event of non-compliance with the terms of the agreement or submission of false data, the Lessor has the right to transfer the personal, registration, and image data of the Lessee and additional drivers to law enforcement authorities and to lists of dishonest clients and business partners.<br \/>9) After booking a car via the website, the rental agreement will be prepared before the car is handed over.<br \/>10) MAYS Family Company sp. z o.o. may refuse to hand over the car after a reservation has been made via the website without stating a reason.<br \/>11) Car reservations made via the website for pick-up outside office hours or delivery to a specified address must be confirmed by phone.<br \/>12) The rental company does not refund money paid in advance for car reservations made via the website. The reservation is completed, accounted for, and invoiced. The client may use the paid money at any other time after arranging the nearest available date.<br \/>13) Payments are handled by PayLane sp. z o.o. with its registered office in Gda\u0144sk, ul. Norwida 4, postal code: 80-280, KRS: 0000227278.          <\/p>\n<\/div>\n<\/div>\n<h4 style=\"font-size: 16px; line-height: 24px; text-align: justify;\" class=\"vc_custom_heading\">II. Basic Obligations: <\/h4>\n<div class=\"wpb_text_column wpb_content_element \" style=\"text-align: justify;\">\n<div class=\"wpb_wrapper\">\n<p>1) The Vehicle Lessee is obliged to:<br \/>a) carry valid documents required by traffic control (a valid driving license honored in the territory of the Republic of Poland, vehicle registration certificate, proof of third-party liability insurance),<br \/>b) secure the Vehicle against theft (always lock the Vehicle and activate all anti-theft devices),<br \/>c) perform daily Vehicle maintenance at their own expense and effort, i.e.:<br \/>\u2013 checking and topping up fluid levels, i.e., brake fluid, engine oil, coolant, washer fluid,<br \/>\u2013 checking tire pressure and tire condition,<br \/>\u2013 checking the operation of signal lights, low beams, and high beams,<br \/>\u2013 maintaining the Vehicle in proper cleanliness,<br \/>\u2013 using fuel in Vehicles that complies with the engine specification provided in the registration certificate,<br \/>\u2013 complying with the Vehicle manufacturer's recommendations indicated in the Vehicle's operating manual.<br \/>2) The Lessee is not permitted to:<br \/>a) tow other vehicles with the Vehicle,<br \/>b) make any modifications or other changes to the Vehicle that are contrary to its characteristics and intended use,<br \/>c) exceed the permissible number of passengers or the permissible load capacity of the Vehicle,<br \/>d) smoke tobacco in the Vehicle,<br \/>e) perform other activities that may cause damage to the Vehicle.<br \/>3) Smoking is strictly prohibited in all Mays rental cars. Failure to accept the above provision in the Rental Regulations will result in a one-time fee of PLN 500 for the Company or the renting individual. <\/p>\n<\/div>\n<\/div>\n<h4 style=\"font-size: 16px; line-height: 24px; text-align: justify;\" class=\"vc_custom_heading\">III. Breakdown, Service, and Repair: <\/h4>\n<div class=\"wpb_text_column wpb_content_element \" style=\"text-align: justify;\">\n<div class=\"wpb_wrapper\">\n<p>1) Unless otherwise stipulated in the agreement, the Lessor is not liable for damages incurred by the Lessee as a result of a Vehicle breakdown, damage, accident, or collision, unless the damage was caused by the Lessor due to willful misconduct.<br \/>2) In the event of a Vehicle breakdown or the need for service, the Lessee is obliged to immediately notify the Lessor. In the event of a malfunction or damage to mechanical components of the Vehicle, it is forbidden to continue driving without the Lessor's consent.<br \/>3) The Lessee is not entitled to commission any repairs, corrections, modifications, inspections, or other repair and maintenance activities<br \/>on the Vehicle without the prior written consent of the Lessor's authorized representative. Such consent may also be issued electronically (e-mail).<br \/>4) The Lessor's authorized representative is the Technical Advisor, who operates the Technical Helpline, tel.: +48 728 428 000<br \/>5) Service requests are made orally (by phone or in person) with justification (breakdown, collision, etc.). The request should be directed to the Lessor's Technical Advisor. The Technical Advisor analyzes the request and manages the Vehicle service (repair) process, directing it to the appropriate service station and directly commissioning the necessary work.<br \/>6) Inspections and repairs must be carried out only at mechanical and bodywork-paint shops indicated by the Lessor's authorized representative throughout Poland. The Lessee is not entitled to perform scheduled Vehicle maintenance outside Poland.<br \/>7) The Lessee is not authorized to sign invoices for work performed as an \"authorized person to receive the invoice\" or to make declarations of will on behalf of the Lessor.<br \/>8) If the Lessor grants consent for the Lessee to perform service activities, the Lessee is obliged to ensure, with due diligence, that all commissioned work has been reliably performed and to sign the Vehicle acceptance protocol from the service. The Lessee is also obliged to ensure that all data required by the guarantor related to the performance of the warranty or post-warranty inspection of the Vehicle are recorded in the Vehicle's technical documentation.<br \/>9) The Lessee is responsible to the Lessor for Vehicle damage, unless the Vehicle damage occurred without the Lessee's fault. In particular, the Lessee is liable for Vehicle damage resulting from a lack of engine oil, lack of gearbox oil, lack of brake fluid, maintaining inappropriate tire pressure, exceeding the permissible load capacity, using the Vehicle contrary to its intended use, operating manual, and applicable regulations and rules for the use and operation of motor vehicles and their components.<br \/>10) Using the manufacturer's or vehicle insurer's Assistance does not release the Lessee from the obligations listed above.         <\/p>\n<\/div>\n<\/div>\n<h4 style=\"font-size: 16px; line-height: 24px; text-align: justify;\" class=\"vc_custom_heading\">IV. Damage, Accident, Burglary, Vehicle Theft \u2013 Procedure: <\/h4>\n<div class=\"wpb_text_column wpb_content_element \" style=\"text-align: justify;\">\n<div class=\"wpb_wrapper\">\n<p>1) In the event of a road accident\/collision\/burglary\/Vehicle theft, the Lessee is obliged to always call the Police and ensure that a report is drawn up at the scene of the accident. With the Lessor's individual consent, this obligation may be waived for minor damages covered by the comprehensive insurance policy.<br \/>2) In the event of Vehicle damage, particularly as a result of a road accident, collision, vehicle burglary, or Vehicle theft,<br \/>the Lessee is obliged to:<br \/>\u2013 immediately notify the Lessor's authorized representative (Lessor's Technical Advisor),<br \/>\u2013 immediately report the damage to the insurer (within the period specified in the general terms and conditions of comprehensive insurance or within 3 business days in the case of damage settled under the perpetrator's third-party liability insurance),<br \/>\u2013 strictly follow the instructions of the Lessor's authorized representative (Lessor's Technical<br \/>Advisor),<br \/>3) The Lessee, when reporting a road accident, collision, vehicle burglary, or Vehicle theft, is entitled to inform the Lessor of their desire to use the comprehensive insurance policy. The Lessor manages the process related to the settlement of motor claims, but this can only be effectively carried out with the active participation of the Vehicle user. In connection with the Lessee using the comprehensive insurance policy, the Lessee is obliged to pay the fee specified in the price list.<br \/>4) The Lessee is not permitted to repair a damaged Vehicle on their own.    <\/p>\n<\/div>\n<\/div>\n<h4 style=\"font-size: 16px; line-height: 24px; text-align: justify;\" class=\"vc_custom_heading\">V. Other Provisions:<\/h4>\n<div class=\"wpb_text_column wpb_content_element \" style=\"text-align: justify;\">\n<div class=\"wpb_wrapper\">\n<p>1) The Lessee is obliged, upon termination of the rental, to return the Vehicle to the location agreed upon by the parties. The return of the Vehicle to a location other than that agreed upon at the time of concluding the rental agreement is permissible after agreement with the Lessor, upon payment of the Fee specified in the Table of Fees.<br \/>2) The intention to extend the Vehicle rental period must be reported at least 12 hours before the return deadline. Extending the rental period by at least 24 hours requires a written agreement with the Lessor, concluded at the Lessor's premises. Failure to report the intention to extend the rental of the Vehicle and not returning the Vehicle within 24 hours from the end of the rental period will be treated as misappropriation of the Vehicle and reported to the Police. In the event of delay in returning the Vehicle, the Lessee is obliged to pay the Fee specified in the Table of Fees. In the event of failure to return the Vehicle on time, the Lessor is authorized to collect the Vehicle, keys, policy, and other Vehicle documents from the Lessee and to charge the Lessee for all costs incurred in connection therewith.<br \/>3) The Lessee is obliged to return the Vehicle with the same amount of fuel as received upon Vehicle collection. For any fuel shortages, the Lessee shall pay the Fee specified in the Table of Fees.<br \/>4) After the return or exchange of Vehicles used by the Lessee, the Lessor has the right to charge the Lessee the following costs:<br \/>a) supplementing the Vehicle's equipment or its parts described in the Vehicle Handover\/Acceptance Protocol and compensation for wear and tear exceeding normal Vehicle use inside or outside (including upholstery elements, hubcaps and rims, and tires),<br \/>b) repair of Vehicle damage caused by improper Vehicle operation or Lessee's negligence, for which<br \/>the insurer is not liable under the comprehensive insurance agreement,<br \/>c) restoring the Vehicle to a condition corresponding to normal wear and tear.<br \/>5) In the cases listed in point V no. 4), the amount of compensation is determined based on a repair calculation prepared by an authorized dealer or based on a VAT invoice documenting the costs of removing damage or supplementing Vehicle equipment. In the case of a repair calculation, the Audatex system will be used to determine repair costs, and in the case of the need to purchase parts, the dealer's currently applicable parts price lists will be used.<br \/>6) The Lessee is not responsible for operational damage to the Vehicle. In the Vehicle Acceptance Protocol indicates only<br \/>Vehicle damage other than operational. The Lessee is entitled to submit reservations to the Vehicle Acceptance Protocol if they dispute the type of damage entered in the Vehicle Acceptance Protocol.<br \/>7) The Lessor, in the event of Vehicle immobilization for a period longer than 24 hours, will, if possible, provide the Lessee with a replacement car. The replacement car should, if possible, have a standard corresponding to the standard of the Vehicle.          <br \/>A replacement car will not be provided in the event of:<br \/>a) the occurrence of at least one of the following events: loss of the registration certificate, insurance policy, car keys, license plate(s),<br \/>b) Vehicle immobilization outside the territory of the Republic of Poland.<br \/>8) The Lessee is obliged to return the replacement vehicle immediately after collecting the Vehicle, but no later than the day after receiving information about the Vehicle's repair.<br \/>9) In the event of the Lessee losing the Vehicle's registration certificate or insurance policy or keys or license plate(s)<br \/>of the Vehicle, the rental continues, and the Lessor undertakes to immediately recreate the missing item.<br \/>10) In the event of loss of Vehicle keys, the Lessee is obliged to immediately secure the Vehicle against theft and to immediately notify the Lessor's authorized representative of the loss of keys and to follow their instructions.<br \/>11) Vehicles have full third-party liability (OC) and comprehensive (AC) insurance, releasing the Lessee and Vehicle user from liability in the event of a collision and theft within the scope of standard conditions, with the exception of exclusions resulting from the general terms and conditions of vehicle insurance, and in particular:<br \/>a) intentional damage to the Vehicle<br \/>b) damage while driving the Vehicle under the influence of alcohol, intoxication, after using drugs or psychotropic substances, or without a valid driving license<br \/>c) if the driver fled the scene of the incident,<br \/>d) Vehicle theft if the user did not secure the Vehicle against theft, excluding cases of robbery in accordance with the provisions of the general terms and conditions of insurance contracts,<br \/>e) Vehicle theft in which not all installed anti-theft devices were activated,<br \/>f) other damages if not covered by the insurer or the perpetrator of the damage,<br \/>g) other cases resulting from the general terms and conditions of insurance contracts and legal provisions.<br \/>12) The Lessee is obliged to familiarize themselves with the provisions of the policy, the general terms and conditions of vehicle insurance contracts, and changes to the general terms and conditions of vehicle insurance contracts, and to comply with their provisions under penalty of liability for damages caused. The applicable general terms and conditions of insurance contracts are published on the insurers' websites. The Lessor provides the Lessee with the applicable general terms and conditions of insurance contracts upon conclusion of the rental agreement and at any time at the Lessor's branch.<br \/>13) The Lessor declares that the Vehicle has the anti-theft security required by the insurer.<br \/>14) The Lessee acknowledges that a condition for the insurer to pay compensation is for the Vehicle user to report the damage within the period indicated by the insurer. The Lessee undertakes to ensure that, in the event of a motor claim or other damage falling within the scope of risk covered by the perpetrator's third-party liability insurance or comprehensive insurance, the Vehicle user, in agreement with the Lessor, reports the damage to the insurer, signs the appropriate declarations required for the damage settlement procedure, provides the documents indicated by the insurer, and fulfills other requirements indicated by the insurer.   <br \/>15) Moving the Vehicle outside the territory of the Republic of Poland is permitted under the following conditions:<br \/>a) to all European Union countries, provided that written consent is obtained from the Lessor upon the Lessee's request and after payment of the appropriate fee in accordance with the Lessor's current price list,<br \/>b) to other European countries, provided that:<br \/>\u2013 it is consistent with the territorial scope of the comprehensive insurance policy,<br \/>\u2013 individual written consent is obtained from the Lessor upon the Lessee's request,<br \/>\u2013 the planned date of stay abroad is provided,<br \/>\u2013 the appropriate fee in accordance with the Lessor's current price list is paid and any fee related to the necessity of purchasing additional insurance (comprehensive insurance extension, Green Card, etc.) is settled.<br \/>c) it is forbidden to move the Vehicle to Russia, Ukraine, Belarus, Moldova, and Kosovo without written consent from the Lessor and without additional comprehensive insurance consistent with the territorial scope.<br \/>16) During trips outside the country, the scope of services provided by the Lessor is limited, and the quality of support depends on the specifics of the given region.<br \/>17) During the rental period, the Lessor will be obliged to repair partial damages to the Vehicle only if they pose a threat to the safety of Vehicle users or third parties.<br \/>18) The Lessee is obliged to cover administrative fees related to the Lessee's use of the Vehicle and imposed on the Lessor, in particular, this applies to fees for parking the vehicle in paid parking zones and additional fees for non-payment of parking fees.<br \/>19) MAYS Family Company sp. z o.o. is not responsible for items left in the car. After one month from the return of the car, all items become the property of MAYS Family Company sp. z o.o.<br \/>20) For class B and C vehicles, a mandatory deposit of at least PLN 300 applies to persons under 25 years of age.   <\/p>\n<p><strong>TABLE OF FEES (amounts are gross):<\/strong><\/p>\n<table width=\"557\">\n<tbody>\n<tr>\n<td><\/td>\n<td><\/td>\n<td>1.<br \/>\nWaiver of administrative fee for motor claim settlement process. National provisions regarding personal data protection will also change; in particular, the current Act of August 29, 1997, on the protection of personal data will be repealed, and the Act on the protection of personal data of May 10, 2018, will become effective (these provisions are hereinafter collectively referred to as \"GDPR Provisions\").   <\/p>\n<p>In connection with the implementation of the GDPR Provisions, MAYS Family Company sp. z o.o. with its registered office in Krakow, at ul. Stanis\u0142awa Lema 24\/LU1 (hereinafter Mays), informs about the principles of processing your personal data and your related rights. <\/p>\n<p>The following rules apply from May 25, 2018.<\/p>\n<ol>\n<li><strong><u> INDICATION OF THE PERSONAL DATA CONTROLLER<\/u><\/strong><\/li>\n<\/ol>\n<p>The Personal Data Controller is Mays (hereinafter: the \"Data Controller\"). Stanis\u0142awa Lema 24\/LU1 with the note \"Personal data\".   <\/p>\n<ol>\n<li><strong><u> PURPOSE AND SCOPE OF PERSONAL DATA PROCESSING<\/u><\/strong><\/li>\n<li>Mays processes your personal data:<br \/>a) for the purpose of taking action before concluding a contract at the request of the data subject or for the purpose of performing a contract to which the data subject is a party [Art. 6 sec. 1 lit. b. GDPR Regulation],<br \/>b) for the purpose of fulfilling a legal obligation incumbent on the Data Controller [Art. 6 sec. 1 lit. c. GDPR Regulation],<br \/>c) based on a legitimate interest [Art. 6 sec. 1 lit. f. GDPR Regulation] for the purpose of:<br \/>I. direct marketing of MAYS Family Company sp. z o.o.'s own products or services;<br \/>II. organizing and conducting contests and other marketing campaigns,<br \/>III. monitoring and improving the quality of services provided, including monitoring telephone calls and surveying customer satisfaction with the services provided,<br \/>IV. risk management and internal control,<br \/>V. pursuing or securing claims,<br \/>VI. providing information about proposed changes to the Agreement, including the Regulations and Price List,<br \/>VII. handling complaints and claims regarding services provided by MAYS Family Company sp. z o.o..       <\/li>\n<li>Furthermore, Mays may, based on separate consent [Art. 6 sec. 1 lit. a. GDPR Regulation], process data for the purpose of:<br \/>a) analyzing customer preferences and interests or developing services based on automated processing by the Data Controller. Based on the created customer profile, the Data Controller may:<br \/>I. adapt services to the individual interests of the customer,<br \/>II. propose a personalized offer;<br \/>b) marketing of own products or services and similar products and services offered by Mays' partners,<br \/>c) direct marketing of products or services of entities cooperating with Mays, provided that the customer's personal data will not be disclosed to third parties;  <\/li>\n<li>The marketing referred to in points b) \u2013 c) above may be carried out by Mays via electronic communication means, i.e., SMS, e-mail, MMS, mobile application on the phone, and communication via telephone.   <\/li>\n<\/ol>\n<p><strong><u>III. PERIOD OF PERSONAL DATA PROCESSING <\/u><\/strong><\/p>\n<p>Your data will be processed for the period necessary to achieve the purposes indicated in point II, including:<br \/>a) for the duration of the contract, and after its expiry, for the period necessary for:<br \/>post-sales customer service (e.g., handling complaints)<br \/>securing or pursuing any claims belonging to Mays<br \/>for fulfilling the Data Controller's legitimate legal obligation resulting from legal, tax, and accounting regulations;<br \/>b) personal data processed for the purpose of marketing Europcar's own products or services based on a legitimate legal interest will be processed until the data subject objects;<br \/>c) personal data processed based on separate consent will be stored until its withdrawal. <\/p>\n<ol>\n<li><strong><u> RIGHTS OF THE DATA SUBJECT<\/u><\/strong><\/li>\n<\/ol>\n<p>You have the following rights resulting from the GDPR Provisions:<br \/>a) the right to access processed personal data, i.e., the right to obtain confirmation from the Data Controller whether and to what extent personal data is processed;<br \/>b) the right to rectification of data if there is a reasonable suspicion that the processed data is inaccurate or incomplete;<br \/>c) the right to restriction of data processing, including: i. the right to withdraw previously granted consents (withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal), ii. the data subject has objected to data processing \u2013 until it is determined whether the objection to data processing is justified in relation to the Data Controller's legitimate interest<br \/>d) the right to erasure of personal data in cases where: i. the data are no longer necessary for the purposes for which they were collected or otherwise processed, ii. the data subject has objected to data processing, iii. the data subject has withdrawn consent on which the processing is based and there is no other legal basis for processing, iv. the data are processed unlawfully in accordance with applicable law, v. the data must be erased to comply with a legal obligation.<br \/>e) the right to data portability via the Data Controller to another controller if processing is based on a contract concluded with the data subject or on consent expressed by such person;<br \/>f) the right to lodge a complaint with the competent supervisory authority if it is considered that the personal data processed by MAYS Family Company sp. z o.o. violates the GDPR Provisions;<br \/>g) the right to obtain intervention from the Data Controller, to express one's own position, and to challenge a decision based on automated data processing.         <\/p>\n<p>The rights listed in points a) \u2013 g) above can be exercised by contacting the Data Controller (address provided at the beginning, with the note: \"Personal Data Protection\").<\/p>\n<ol>\n<li><strong><u> INFORMATION ON RECIPIENTS OF PERSONAL DATA<\/u><\/strong><\/li>\n<\/ol>\n<p>In connection with the processing of personal data for the purposes specified in point II, your personal data may be disclosed to the following recipients or categories of recipients: <br \/>a) entities participating in processes necessary for the performance of contracts concluded with you,<br \/>b) entities supporting Mays in its business processes, including entities processing personal data on behalf of Mays (so-called Mays processors) participating in the performance of our activities, including: agents, advertising agencies, sponsors, and other entities participating in the sale of our services or the organization of marketing campaigns;<br \/>c) entities related to Mays within the Mays capital group, in the performance of reporting and financial statement obligations;<br \/>d) entities providing telecommunications services;<br \/>e) entities providing debt collection services and entities acquiring receivables \u2013 in case of your non-payment of our bills or invoices on time;<br \/>f) entities providing banking services, for the purpose of making refunds to you or for the purpose of providing direct debit services;<br \/>g) entities providing courier or postal services;<br \/>h) entities providing transport services;<br \/>i) entities printing correspondence and handling correspondence from clients;<br \/>j) economic information bureaus and BIK (Credit Information Bureau) to receive information about your debt, which is available in these bureaus;<br \/>k) Polish Bank Association to verify whether your identity document has been reported to the Reserved Documents System;<br \/>l) entities archiving documents;<br \/>m) entities conducting customer opinion surveys;<br \/>n) entities providing technical services to MAYS Family Company sp. z o.o., including: developing and maintaining IT systems and websites and providing MAYS Family Company sp. z o.o. with ICT tools;
